Welcome to Gig Quest (the “Platform”), a freelancing marketplace connecting businesses and individuals (“Clients”) with skilled professionals (“Freelancers”). By accessing or using our Platform, you agree to these Terms of Service.
1. Using Gig Quest
- Clients may post projects, review freelancer proposals, and hire professionals for services.
- Freelancers may create profiles, showcase skills, and apply to projects posted on the Platform.
- You must be 18 years or older to use the Platform, or have legal capacity under Kenyan law.
- Users are fully responsible for ensuring that all information provided (personal, professional, and payment-related) is accurate and up to date.
2. Accounts & Profiles
- You are responsible for safeguarding your account credentials and all activity under your account.
- Profiles must reflect real individuals or businesses. Fake, misleading, or misrepresented profiles will be suspended or permanently removed.
- Each user may only maintain one active account unless expressly approved by Gig Quest.
3. Projects & Communication
- Before beginning work, Clients and Freelancers must clearly agree on scope, timelines, deliverables, and payment terms.
- All communication between users should remain professional, respectful, and free of abusive language or conduct.
- Attempting to take projects “off-platform” to avoid visibility or future service fees may result in account suspension.
4. Payments
- Currently, Gig Quest does not charge service fees. Freelancers keep 100% of what they earn.
- Clients and Freelancers are strongly encouraged to align on payment schedules, amounts, and methods before work begins.
- Payments conducted outside the Platform are the responsibility of the Client and Freelancer. Gig Quest is not liable for any missed, delayed, or incomplete payments.
5. Fair Use & Prohibited Conduct
You may not use Gig Quest to:
- Post or solicit fraudulent, illegal, or harmful projects.
- Harass, exploit, or discriminate against other users.
- Upload, share, or distribute malware, viruses, or harmful software.
- Circumvent Gig Quest systems or processes to avoid compliance or fees (once applicable).
Violations of these rules may result in immediate suspension or termination of your account.
6. Dispute Resolution
- Clients and Freelancers are encouraged to resolve disputes through open communication and documentation of agreements.
- While Gig Quest does not currently provide arbitration services, we may intervene to investigate misuse or repeated violations of the Platform.
7. Intellectual Property
- Freelancers retain ownership of their work until the agreed payment is received.
- Once payment is made, intellectual property rights transfer to the Client as per the project agreement.
- Both parties must respect and comply with applicable copyright and intellectual property laws.
8. Limitation of Liability
- Gig Quest provides the Platform “as is” and does not guarantee the quality of services, project outcomes, or payment completion.
- Users acknowledge that all projects are agreements between Clients and Freelancers directly. Gig Quest is not responsible for losses, damages, or disputes that arise from engagements on or off the Platform.
9. Changes to Terms
Continued use of the Platform after updates means you accept the revised Terms.
Gig Quest may amend these Terms periodically to reflect changes in operations, policies, or applicable law.
